Judicial Review | Judicial Review is a process by which a decision (decision to do something; decision not to do something; or a policy) made by a public body (e.g. the Home Office, HM Passport Office or even the Tribunal) that is not appealable is still challenged by way of referring it to the judiciary to determine whether it had been correctly arrived at.
In other words, a Judicial Review is a means by which you would ask a judge to check whether in arriving at a decision a decision-maker either put weight on factors they should not have put weight on or did not put weight on factors they ought to have. Judicial Review could go through several stages at each of which it may either: be defeated; continue to the next stage; or succeed. It is important to note that to undertake a Judicial Review there should be merits in doing so otherwise, you may be liable for the litigation costs of the Home Office should you lose. Pre-action Stage It may well be at this stage a visit visa refusal is determined by the Entry Clearance Manager to have been incorrectly decided by the Entry Clearance Officer and then a new decision will be made. The new decision may be still to refuse the application or else it could be granted. Sometimes the pre-action correspondence is ignored. Our fees for this stage are £850.00 – £1,500.00 Stage 1 – Permission Stage (Stage 2 – Possible Renewal Stage) Our fees for this stage are £850.00 – £1,200.00 Stage 3 – Substantive Hearing Stage It should be noted that to win at Judicial Review does not mean that the judge him- or herself necessarily will be substituting the decision for the one you want. He or she will be remitting the application or the appeal or another process back down to that decision-maker to be reconsidered this time correctly (e.g. this time not putting weight on factors they ought not to have the first time around; or this time putting weight on factors they ought to have the first time around). Our fees for this stage are £1,500.00 – £2,500.00. (Other stages may be involved e.g. Injunctive Relief for which our fees would be discussed) |

Judicial Review is a potentially complex, costly and time-consuming process the full details of which will be discussed on a case-by-case basis and may involve Counsel.
