“Permanent residence” relates to European Economic Area nationals residing in the UK for at least five years whilst exercising Treaty Rights. Exercise of Treaty Rights may be: employment; self-employment; job-seeking for up to three months in a 12 month period; self-sufficiency of income/savings together with comprehensive private medical insurance for yourself and your entire family; and studying in the UK together with comprehensive private medical insurance for yourself and your entire family. Although technically one will have permanent residence as an automatic operation of European Community law under such circumstances, given the uncertainties over Brexit and the introduction of “settled status”, it is advisable to now make an application in all cases.
